For the purpose of these terms and conditions (which are in addition to the standard terms and conditions found at www.o2.ie/terms) which shall govern the use of your O2 service (‘Service’), “We”, “Us” and “Our” means Telefonica Ireland Limited of 28-29 Sir John Rogerson’s Quay, Dublin 2 and “you”, “your” or “customer” means you as a user of the O2 Priority Moments service. By subscribing under O2 Priority Moments or O2 More or using O2 Priority Moments, you are deemed to have accepted these terms and conditions.
Further Definitions: “Moment(s)” means any offer listed under Priority Moments at www.o2.ie generally, or any special or specific offer or promotion offered to you from time to time, which may be provided by O2 directly, or by Offer Providers. “Offer Provider(s)” means any third party provider of a Moment.
This permission-based marketing and reward Service is available to all O2 customers aged 16 years or over, resident in the Republic of Ireland who register (or are already registered through O2 Priority Moments or O2 More) on o2.ie, or through specific mobile application, using a mobile number (rather than on an account level).
By availing of any Moment you will be deemed to have additionally accepted any additional terms and conditions of the Offer Providers and any other requirements set out in any promotional material, as you note that all Moments are subject to further conditions or limitations on their redemption or use. A failure to comply with any of these terms and conditions may result in the Moment being forfeited. You are advised that certain offers shall only be available to users aged 18 years or over. We will tell you when this is the case.
Moments listed may be regularly updated and changed. Access to the Moments is subject to availability. We make no commitment availability or the length of time in which a Moment will remain open and capable of redemption. We will not be responsible if your application for a Moment is incomplete, lost or not received.
Moments may be redeemed in a variety of ways and be subject to such qualifications as may be specified online, or further specified or set out by the Offer Provider.
Charges may apply if you receive a message from O2 Priority Moments that offers you the opportunity to browse and or call to learn more.
Roaming charges may apply if you are roaming when you receive a message from O2 Priority Moments and you reply/call or browse.
Unless otherwise specified, Moments cannot be sold or used in conjunction with any other voucher or promotion. Any Moments chosen by you are non-transferable and non-exchangeable for any other offer, cash, or used in any other way than that described.
We cannot be held responsible for any alterations or cancellations to Moments. We reserve the right to: (i) change Offer Providers without prior notice; or (ii) amend any Moment without prior notice for any reasonable legal, technical, regulatory or commercial reason.
We reserve the right to change this Service, these terms and conditions, or to discontinue any aspect or feature of the Service (including any Moments) at any time without prior notice. Your continued subscription to and/or use of the O2 Priority Moments service will be deemed to have accepted the varied terms and conditions which will be posted on www.o2.ie.
Please note that any conditions on the use of such Moments are a matter between you and the Offer Provider. You must deal directly with the Offer Provider and any dealings are a matter between the two of you. You agree that the use of Priority Moments is at your own risk and we will not be responsible for any injury, loss or damage of any sort incurred as the result of any such dealings with, use of Moments, or as a result of any dealings of Offer Providers on Moments. We will not be held responsible for the quality of any Moment or service that you may avail of, this is solely between you and the individual Offer Provider, including in respect of payment, delivery or any other terms, conditions, representations or warranties associated with such dealings. You agree that We do not have any responsibility or liability to you for goods and services supplied by such third parties, or howsoever arising through your engagement with same.
You acknowledge and agree that We are not responsible for the availability of any third party Websites or material you access through this Service. We do not endorse and shall not be held responsible or liable for any content, advertising, products or services on or available from such websites or material.
Components of the Service are supplied to us by third parties and We cannot be held responsible for and do not accept any liability, either express or implied as to such components, including but not limited to their accuracy, relevance or quality.
Any use of the service by you is on an "as is" and an "as available" basis. You agree and accept that O2 Priority Moments are for your own personal use and shall not be used for commercial purposes. In respect of the Service and individual Moments all conditions, terms, warranties and representations whether express or implied by law are excluded to the fullest extent permitted by law.
You warrant the accuracy of any information provided to us for this, or other O2 Services and acknowledge that you will indemnify us against any liability, issue or cause arising out of any fraud or misrepresentation of information by you. You acknowledge that services or offers may be withdrawn from, or unavailable to, you as a result of any such deception.
This Service is available only for subscription through online mechanisms, including our webpages, mobile internet or applications and we may contact you through these mechanisms in relation to the scheme from time to time. Please note that withdrawal from the Service or amendment of marketing consents may render you unable to receive notification and details of all Moments available to you or the privileges and benefits of such scheme. You acknowledge that any service messages to use the Service or redeem Moments shall supersede any marketing consents indicated.
You agree and acknowledge that through acceptance, we, or our agents, may use the information supplied by you, including your location data, for the following purposes, which shall include but are not limited to: sending you applicable Priority Moment messages, providing you with the Service or the redemption facility of such Service, monitoring the use of the service, from time to time evaluating if we can improve the service for customers, or providing you with information on/or offers of other products and services which we feel may be of interest to you. For the limited purposes of verification of eligibility and to facilitate the redemption of Moments, some of your data may be supplied to Offer Providers.
Your information will at all times be treated in accordance with our Privacy and Cookies Policy and you can amend/remove your subscription to this particular service, or consents as to use of location data at any stage through your permissions and preferences page on My Account.
In subscribing to O2 Priority Moments, you are also deemed to have subscribed to our marketing and information service O2 More, which involves the provision of third party information or offers of our partners which we feel may be of interest to you. The terms and conditions applicable to this service are available at O2 More and you may opt out of this service through your permissions and preferences page on My Account.
If any part of these terms are held by a court of competent jurisdiction to be invalid, illegal or unenforceable, the validity or enforceability of the remainder of these terms shall not be affected and such provision shall be deemed modified to the minimum extent necessary to make such provision consistent with applicable law and, in its modified form, such provision shall then be enforceable and enforced
These terms and conditions shall be governed by and construed in accordance with Irish Law.
23. The Priority Moments service is provided by Telefònica Ireland Limited of 28/29 Sir John Rogerson’s Quay or such other service provider as we may specify from time to time. O2 Priority Moments Data Protection Notice
This notice explains further how Telefonica Ireland Limited (O2) (in association with its Group Companies and any agents used to provide the service) may use the personal information provided by you through this O2 Priority Moments service. This is in association with our commitments to you under our Privacy and Cookies Policy.
Where you have registered and not opted-out of the service, we will process and analyse the following:
Your registration details, including from other O2 products and services;
Details relating to how you use the above services i.e. which offers you have availed of through O2 Priority Moments or the average number of SMS used through your mobile phone account; and/or
Your personal contact details as supplied by you and your location data.
We will process and analyse these to:
Help manage O2 Priority Moments and the way we run it and provide you with information on the Service;
Understand our customers usage habits to improve our services;
Unless you have indicated otherwise, contact you, via email, phone, including through SMS and MMS, and by post, with offers, promotions and information about products and services from O2 and those of our selected partners that we feel may be of interest to you. These messages may also be location specific, using your location data, unless you have otherwise indicated; and
Fulfill and deliver O2 Priority Moments offers and/or competition prizes. This may involve the sharing of your data with third parties for the purpose of delivery to you.
